Jailbreaking iPhone is not a crime. This has been ruled by the U.S. Copyright Office and the Library Congress. The verdict has come as a shocker for corporate giant Apple that in past had claimed that jailbreaking jeopardized security. Besides, the company had also claimed that it violated the terms of fair use.
Keeping all this in mind Apple had approached the Copyright Office. But its effort has failed to convince the Office that jailbreaking the iPhone was a violation of the Digital Millennium Copyright Act.
In a historic decision today that will have long-term impact on the industry, the U.S. Copyright Office and the Library of Congress ruled out that jailbreaking the iPhone was not prohibited by the act. The Electronic Frontier Foundation also follows the same line.
However, Apple has not given up. In defense it cited security and privacy concerns. It made all-out effort to declare jailbreaking illegal. Besides, it fought to keep today’s decision from becoming a reality, but to no affect.
Librarian of Congress James Billington wrote that Apple called jailbreaking a "violation of the prohibition against circumvention of access controls. It stated that its validation system is necessary to protect consumers and Apple from harm. Apple further contended that modifying Apple’s operating system constituted the creation of an infringing derivative work.”
