November 7: Beatles catalog: Websites barred from selling EMI’s Beatles songs. BlueBeat.com and BaseBeat.com have been restrained by a California district judge from selling re-mastered songs of Beatles and other EMI artists. EMI Group that sued these websites shares the rights of Beatles songs with Apple Corp.

Beatles re-mastered collection had never been available online even through iTunes for download before BlueBeat.com started offering selling selections from Beatles and other EMI artists like the Beastie Boys, Coldplay, Pink Floyd, Radiohead, and Smashing Pumpkins for 25 cents apiece.

While BlueBeat owner has not commented on the court order the site has removed all the re-mastered Beatles collections except the Beatles #1 album and the soundtrack for The Beatles: Love.

BluBeat.com has time till November 10 to submit its opposition to the temporary injunction order.

EMI wants the Judge John F. Walter to issue a permanent injunction and a compensation of up to $150,000 per song against BlueBeat owner Hank Risan.

Risan had written to Recording Industry Association of America (RIAA) that his site was selling songs that were altered via "psycho-acoustic simulation" instead of the original copyrighted works.

Risan later explained "psycho-acoustic simulation" as being his synthesis of the series of sounds that best expresses a melody.
